Terms and Conditions of Sale

1. Definitions

In these Terms:

  • “Business Day” means any day other than a Saturday, Sunday or bank holiday in England.
  • “Contract” means the agreement between you and us for the sale of Goods.
  • “Goods” means the products supplied by us as specified in your Order.
  • “Order” means your purchase request.
  • “Order Confirmation” means our written acceptance of your Order.
  • “Price” means the total amount payable.
  • “We/Us/Our” means Natural Paving Store Ltd.

3. The Contract

3.1 Your Order is an offer to purchase Goods.
3.2 A Contract is formed when we issue an Order Confirmation.
3.3 We may refuse any Order at our discretion.


4. Consumer Rights

If you are a consumer, your rights are protected under the Consumer Rights Act 2015 and Consumer Contracts Regulations 2013.

Nothing in these Terms removes or limits your statutory rights.


5. Product Description and Quality

5.1 Product images and descriptions are for guidance only.

5.2 Natural stone products:

  • Vary in colour, texture, and markings
  • May contain natural fissures, veins, and mineral deposits
  • Are inherently non-uniform

These are not defects.

5.3 Porcelain paving:

  • Is batch manufactured
  • May vary slightly between batches

5.4 Tolerances:

  • Natural stone: ±5mm
  • Porcelain: ±3mm

5.5 Samples are indicative only and may differ from delivered Goods.


6. Orders, Amendments and Cancellations

6.1 Orders may be amended or cancelled before entering dispatch.

6.2 Once in dispatch:

  • A £50 per pallet cancellation fee may apply

6.3 Once dispatched:

  • Orders cannot be cancelled
  • Delivery costs will be deducted from refunds

6.4 Express or timed delivery orders cannot be cancelled.

6.5 If we cancel your Order, a full refund will be issued.


7. Price and Payment

7.1 Prices are as displayed at the time of Order.
7.2 Full payment is required before dispatch.
7.3 We reserve the right to cancel orders due to pricing errors.


8. Delivery

8.1 Delivery is kerbside only via third-party haulage.

8.2 Deliveries require:

  • Hard, level surface
  • Access for an 18-tonne vehicle

8.3 You must inform us of access restrictions.

8.4 Failed deliveries may incur additional charges.

8.5 Delivery dates are estimates only.

8.6 Risk passes on delivery. Ownership passes once paid in full.


9. Delivery Acceptance, Inspection and Verification

9.1 You must inspect Goods on delivery.

9.2 Any visible damage must be noted on delivery documentation.


9.3 Mandatory Product Verification Before Opening or Installation

It is the customer’s responsibility to ensure that the correct Goods have been delivered before any packaging is opened or installation begins. This includes checking product type, size, colour, and batch numbers against your Order Confirmation.

If you are using third-party installers, you must ensure they are informed of the correct product and that all checks are completed prior to installation.

Goods must not be opened, moved, mixed, cut, or installed until verified as correct.

Once Goods have been opened, moved, mixed between packs, cut, or installed, they will be deemed accepted as correct, and we may not be able to offer a return, replacement, or refund where the issue relates to incorrect product selection, colour, or batch variation.

This does not affect your statutory rights under the Consumer Rights Act 2015.


10. Damages, Shortages and Claims

10.1 Goods must be inspected within 72 hours of delivery.

10.2 Any issues must be reported within this timeframe with photographic evidence.

10.3 This timeframe enables efficient resolution and does not limit statutory rights.

10.4 Goods must not be installed if damaged or incorrect.

10.5 We cannot accept claims for:

  • Installed materials
  • Labour or contractor costs
  • Removal or reinstallation

11. Waste Allowance and Industry Tolerance

11.1 It is standard industry practice to allow 10% additional material for:

  • Cuts
  • Wastage
  • Minor damage
  • Natural variation

11.2 Limestone may require up to 15% additional material.

11.3 Minor imperfections or edge damage do not constitute faults.

11.4 This guidance does not affect your statutory rights.


12. Natural Stone Characteristics

Natural stone may include:

  • Colour variation
  • Veining and markings
  • Fossil content
  • Natural fissures

These are inherent characteristics and not defects.


13. Porcelain Batch Variation

13.1 Shade variation between batches may occur.

13.2 Customers must check batch numbers before installation.

13.3 Claims after installation relating to colour or batch variation cannot be accepted.


14. Installation Responsibility

14.1 Customers and installers must ensure all materials are:

  • Correct
  • Suitable
  • Acceptable in appearance

before installation.

14.2 Once Goods are cut or installed, they are deemed accepted.

14.3 We are not responsible for:

  • Installation methods
  • Third-party contractors
  • Associated costs

15. Returns and Refunds

15.1 Consumer Cancellation Rights

Consumers may cancel within 14 days under the Consumer Contracts Regulations 2013.


15.2 Returns Eligibility

Returns accepted only for:

  • Full unopened crates
  • Unopened accessories

Non-returnable:

  • Opened packs
  • Split packs
  • Loose slabs
  • Clearance items
  • Made-to-measure goods

15.3 Return Conditions

  • Returns must be authorised
  • Customers pay return costs
  • Goods must be repackaged securely

15.4 Restocking Fees

  • £85 per pallet
  • £10 per accessory item

15.5 Refunds

  • Processed after inspection
  • Issued via original payment method

16. Transport and Minor Damage

Minor damage may occur during transport.
Slight imperfections may still be usable and do not constitute a fault.


17. Environmental Effects

Paving may change over time due to:

  • Weathering
  • Efflorescence
  • Moisture
  • Organic growth

These are natural processes and not defects.


18. Liability

Nothing excludes liability for:

  • Death or personal injury due to negligence
  • Fraud

We are not liable for indirect or consequential losses.


19. Events Beyond Our Control

We are not liable for delays caused by events outside our reasonable control.


20. Data Protection

We process personal data in accordance with our Privacy Policy.


21. Governing Law

These Terms are governed by the laws of England and Wales.
